how to stop debt collectorsI continue to rant about the underground, almost illegal debt collection business.  Between the news coverage exposing just how bad it is and the Federal Trade Commission making a show of shutting these operations down it just doesn’t stop.  Why?  The profits are absolutely insane!

Most of these companies operate out of backrooms, threatening people beyond belief. They pay pennies for old debt and collect thousands in return!  If I can’t put them out of business, I can sure help consumers battle this ugly tide.  A little education and a lot of success goes a long way.  Collections can ruin a person’s credit in a heartbeat.  And it takes a serious effort to undermine a collection agency who is trying to intimidate you.

The facts are that about 80% of collections being reported in the US do not have the proper documentation to report a collection let alone collect it.  Another percentage of these “so called” businesses, don’t even have the proper licensing to operate in many states where they are trying to collect debts.

Junk debt buyers, most often known as collection companies, deserve the bad rap they have earned. And today, with the help of the FTC, the Consumer Financial Protection Board and state Attorney Generals the power to remove collections has improved.

When the original creditor writes off the debt, it is often sold to “junk debt buyers”.  They typically receive an Excel spreadsheet of the portfolio of paper they are buying.  And they in turn file a collection on your credit report without ever consulting you first.  Of course this immediately drives down your credit rating.

Under both the Fair Credit Reporting Act and the Fair Debt Collections Practices Act, they must have documentation to prove what they have reported. And this documentation must be made available to you at your request.  But if all they have is an Excel spreadsheet and usually a print out of what the debt was, then how can they clearly show that you owed the debt and further that you now owe them this alleged debt.

In other words, they have to have a copy of that original contract (with your signature) and another contract showing that they now have the right to collect the debt.  We have discovered that in approximately 80% of our cases, these junk debt buyers have neither!

 Sue The Credit Bureaus??? Maybe!

A federal court jury in the United States District Court for the Eastern District of Pennsylvania returned an $800,000 verdict against Trans Union credit reporting agency in a fair credit reporting case. The verdict is the largest known of its kind in a Pennsylvania federal court.

In its vBeat the credit bureauserdict, the jury concluded that Trans Union had violated four provisions of the Fair Credit Reporting Act by not conducting a proper initial investigation; by not making proper disclosures to Cortez when she complained; by failing to note her dispute in subsequent reports; and by failing to have procedures that would ensure “maximum possible accuracy” in its reports.

Should You Sue The Credit Bureaus?

The preferred way to go about it, says Clarksdale, Miss., trial lawyer Michael Lewis, is to sue for defamation. He should know. In 1998 Lewis won a $4.5 million verdict against the credit bureau TransUnion for a client who had been a victim of identity fraud and had been unable to clear his name. The case is under review by the U.S. Fifth Circuit Court of Appeals.

The credit bureaus won’t venture forth to check public documents such as court judgments and county property records, but they will accept copies of supporting documentation from consumers. In rare cases they might even repair a consumer’s credit record based on such documents, “but a month later we’ll get the same old information from the credit grantor again,”Lewis says.

A “shadow world” ripe for a fall!

It’s that kind of attitude toward the consumer that makes Lewis call the credit-reporting industry “a shadow world that is almost beyond the reach of the law and is certainly above and beyond the reach of the consumer.”

We are in agreement that the credit bureaus have terrible quality control, do not verify your actual documents and statements and simply accept the word of those reporting
information about you.  In other words, NO ONE at the credit bureaus ever sees if what they are reporting is accurate or not!!!  Therefore, YOU must FORCE the credit bureaus to comply with the law because the won’t do it on their own!

1. Dispute, Dispute, Dispute!  THERE have been numerous studies done showing that a large majority on Americans have errors on there credit reports,  although a good many simply have bad credit. The first order of business is to write the credit bureaus and dispute the errors and the negatives on your credit.  Whether the information is accurate or not, the credit bureaus MUST INVESTIGATE each request with each creditor.  If the creditor does not reply or is unable to find the records to back up what they reported, then the negative items MUST be removed from your credit report. Dispute, Dispute, Dispute!

2. Collections can really trash a credit report.  If they are old and you pay them or even part of them, your credit report will reflect that payment and the collection becomes new again, lasting for seven more years and damaging your credit scores. If a collection agency verifies your credit bureau investigation, then it’s time to go after the collection company.  Under the law they are required to prove that 1- they have proof of the debt you owe, 2-they have the right to collect the debt and a written agreement with the original creditor, 3-they have the right to do business and collect debts in your state, 4-they can document to the penny what you owe.  Guess what, most collections cannot provide all four of their legal requirements.  If they can’t, they must retract their reporting from your credit report.

Credit Tip – Creditors Are FAR From Perfect…

3. Creditors – The creditors reporting to the credit bureaus are definitely not perfect.  One court judge found that over 90% of credit card companies could not prove that consumers (who had sued them) owed the debt in question.  The law requires that creditors investigate accounts if you ask them.  So ask them.  Ask for the proof documents, ones with signatures proving you owe the debt. Again if they cannot prove what they are reporting, it must be removed from your credit report.
